LogPod — Terms of Service

1. Definitions, and who these terms are with
In these terms:
- "the Supplier" (also "we", "us", "our") means Tin King Tai, of 5E, 5 Science Park East Avenue, Hong Kong Science Park, Hong Kong.
- "the User" (also "you", "your") means the individual who holds a LogPod account.
- "the App" means the LogPod application for iOS.
- "a Team" means a crew whose members share a roster, training sessions and plans in the App.
- "a Roster Entry" means a name, and optionally a weight, recorded against a Team. A Roster Entry is not an account and cannot sign in.
The App is provided by the Supplier. By creating an account the User agrees to these terms.
2. You must be an adult
The User must be 18 or older to hold an account. Accounts are for coaches and adult paddlers.
A coach may add squad members to a Team as Roster Entries. A Roster Entry belongs to the Team, not to the person named. A User who adds someone is responsible for having a proper basis to record that person's name and weight, and for telling them it is recorded.
3. What the app does
The App helps a crew plan a boat and keep a record of training. The User is responsible for the accuracy of what they enter.
It can also record a session using the phone's location and motion sensors, including while the screen is off. Distance and stroke rate are worked out from those readings and are estimates, not measurements from calibrated equipment.
The App is not a safety device. It gives no warnings about weather, water or navigation, and must not be relied on for anything affecting anyone's safety on the water. Decisions about whether it is safe to launch are the User's alone.
4. Your team's data
A Team's roster, sessions and plans are visible to that Team. Anyone the User invites can see them. Coaches and admins can additionally see recorded weights, heights and strength figures.
Sharing a session shows it, and any note attached to it, to the Team. A shared session is reachable through a link that opens the App; it is not a web page and someone outside the Team cannot open it.
The User should not put anything in a Team name, a paddler name, a note or an announcement that they would not want everyone on that Team to read.
5. Your account
The User must keep access to the email address they sign in with; it is the only way in. Tell the Supplier at support@atomylab.com if you believe someone else has access to your account.
6. Acceptable use
The User must not use the App to store data about people who have not agreed to it, to impersonate anyone, to harass or abuse another User, to post unlawful or objectionable content, to attempt to reach another Team's data, or to interfere with the service.
Content posted to a Team may be reported from within the App. The Supplier reviews reports and may remove content and suspend or close the account responsible. The Supplier aims to act on a report within 24 hours.
7. Ending it
The User may delete their account at any time from 我的 → 刪除帳號. What is removed, disconnected or retained is set out in the Privacy Policy.
A User who owns a Team with other active members must transfer ownership first. The Supplier may suspend or close an account that breaches these terms.
8. Availability and liability
The App is provided as it is. The Supplier does not promise it will be available without interruption or free of defects, and does not guarantee that a session will record correctly — a phone can lose signal, run out of battery, or be put down. The User should keep their own record of anything that matters to them.
Nothing in these terms excludes liability that cannot lawfully be excluded. That includes liability for death or personal injury caused by the Supplier's negligence, and liability for fraud. Dragon boat is a water sport and the App is used on and beside the water, so that carve-out is not a formality.
Subject to that, and to the fullest extent the law allows:
- The App is provided without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy of what it records.
- The Supplier is not liable for indirect, incidental or consequential loss, for loss of data, or for any loss arising from reliance on the App for safety, navigation, or medical or training decisions.
- The Supplier's total liability for all claims relating to the App is limited to the greater of what the User has paid for it in the twelve months before the claim, and HK$100.
The App is free to use, so in practice that limit is HK$100.
9. Changes
The Supplier will post changes here and update the date above. Continuing to use the App after a change means the User accepts it.
10. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction.
